Family Law The area of family law includes divorce, child custody, adoption, termination of parental rights, child support issues, and name changes, to name a few. Wills and Estate Planning A will is created as a will packet, which includes a Last Will and Testament, Directive to a Physician, Medical Power of Attorney, Financial Power of Attorney, and Organ Donation Form. Will packets can be produced for individuals or married couples. A will disposes of a person’s property on death and can be as specific as the wishes of the creator. A will can also provide for guardianship provisions for the creator’s children, if the children are minors. Probate Probate is the process of administering an individual’s estate after their passing. It can include a Muniment of Title, Determination of Heirship, Temporary Administration, Small Estate Affidavit, and Dependent or Independent Administration. To determine which type of administration is needed, your attorney will discuss with you the complexity of the estate and the existence of a Last Will and Testament. Guardianship Guardianship is the process of establishing a legal relationship between an incapacitated person and their legal guardian. An incapacitated person can be a minor or an adult with disabilities. |
