General FAQ
Why do I need an attorney?Like any other problem you have when you need the services of a professional, an attorney is trained to assist you with your legal issue. When you retain an attorney, you are paying that attorney for his or her legal expertise and training. How do I retain the services of an attorney? When you decide to retain the services of an attorney, your attorney will quote you a retainer and request that you sign a contract. Legal representation begins when you have funded your retainer and executed the contract. What do I need to take to the initial consultation? Please bring any supporting documentation that you feel will be helpful for the meeting with your attorney. For example, bring copies of tax returns, credit card bills, mortgage statements, retirement statements, and financial account statements. If you have been served with papers, please bring these papers as well. What is a retainer?A retainer is an amount of money put into a savings account just for you, the client. IOLTA or "Interest on Lawyers’ Trust Accountsquot; is required under Texas law and provides that attorneys must deposit all client funds, which are nominal in amount or reasonably anticipated to be held for a short period of time, into a single interest bearing account. Any interest earned must be awarded to The Texas Equal Access to Justice Foundation. The Foundation distributes the funds to legal service providers around the State who are providing legal services to the indigent people of Texas. What happens if my legal fees are less than my retainer? If your legal fees are less that your retainer on file, you will be refunded any un-used monies. If I call the office, can I get legal advice over the phone?According to the laws of Texas, an attorney must establish that there are no conflicts of interest before giving legal advice. Therefore, the attorney will not give legal advice over the phone. However, we are more than willing to set up a consultation to meet with you at your first available date. |
